However, under U.S. immigration laws, once you marry, the government classifies your spouse as an immediate and direct relative. It is a non-immigration visa with a validity of 90 days only. Once your fiancée clears the interview and receives the visa number, she can travel to the U.S. and marry you before the visa expires. If you don’t marry within the required time frame, she must either leave the country or face deportation. First, if you are sponsoring your would-be wife to travel from Ukraine to the States, you need to fill out and submit the I-129F petition. Only US citizens are eligible to use this form and not men who have lawful permanent residence owing to green cards. Also, your spouse can enter the country through the K-1 Fiancé(e) visa, provided you meet these two following conditions.
You must submit a series of supporting documents along with Form I-129F, the petition for a K-1 Fiancé(e) visa. These documents help prove your identity as a U.S. citizen and verify your relationship with your Ukrainian fiancée.
After the approval of Form I-129, your fiancé becomes eligible to apply for the K-1 visa and must attend the required in-person interview. It will be held at the US embassy in Ukraine and also in person.
